If your opponent has no benched pokemon, and you use Flick Poison, is their pokemon poisoned?

I'm not a Professor, but I think the attack does nothing if your opponent has no benched pokemon. That's because the attack says "The new Active Pokémon is now Poisoned", and there will be no "new" active pokemon.

Hunt (Sharpedo EX - Primal Clash)

Q. Does Sharpedo EX's "Hunt" attack do 30 damage if the opponent cannot switch their Active Pokemon to the Bench or if the Bench is empty?
A. If you cannot switch the opponent's Pokemon there is no "new Active Pokemon" to be damaged, so no damage is done. (Feb 5, 2015 TPCi Rules Team)
