To answer your second question, I was told by a head judge that you may use basic energy cards from any language, and any previous sets. With that in place, I don't think energy count towards your 6 card foreign limit since most decks play more than 6 energy, and if you can surpass that number, I highly doubt it counts toward your total.
 
No where under the tournament operating procedures does it say basic energy cards don't count towards the total percent of foreign cards. Using this info, I would rule that they do count towards the 10% foreign language cards.
 
Really? Well that sucks, I would have thought energy would be universal. I have some really cool looking ones that are like shiny on the card and its from japan and it looks like fireworks are going off on the card lol. Its really cool.

But they have different card backs. So they are identifiable.
